NHSTA declares "Drag Racing" a Statutory Crime: Does That Make John Force A Criminal?

Big Daddy Don Garlits and John Force by definition of the US government might be considered as committing a “statutory crime” when “Drag Racing.”  NHSTA* Uniform Vehicle Code 11-809(b) indicates that “Drag Racing” is both an “offense” and a “statutory crime.”  Yet both of these of people are not criminals rather highly celebrated motorsports legends.  Drag Racing is Drag Racing right? Actually No. Here’s why:

Throughout the history of illegal street racing people within a position of authority including government, law enforcement, and media have perpetuated a host incorrect phrases to identify the illegal activity.  The headlines are numerous:

  • California: PE News: Street racing may have led to fatal crash in San Bernardino


Recently in Florida legislation was signed into effect entitled “Luis Ortega street-racing bill” and politicians declared with confidence that “all street racing is illegal.”  Yet within their home state a race only second in spectators to NASCAR’s Daytona 500, the Honda Grand Prix of St Petersburg, is an IndyCar street race on a street circuit.  Is it the intention of these same Florida politicians to cancel this IndyCar street race then?

Illegal Street Racing is the act which is extremely detrimental to our society not street racing, drag racing, drifting, etc.

How as a society can we resolve a problem, if step one, identification of the act, is utterly failing withing people of authority.

It is for this reason why the Evo organization endeavors to work with all affected parties in the position of decision makers and influencers to adopt a universal system of identifying the act.

  • Illegal Street Race: An unsanctioned contest of speed involving one or more vehicles on an open public road.
  • Street Race: A sanctioned contest of speed involving one or more vehicles on a closed public road.
  • Drag Race: A sanctioned acceleration contest between two vehicles on a motorsports track that begins from a standing start and races to a measured finish line. 

*NHSTA: Drag Racing. Either as part of the offense of highway racing or as a separate statutory crime, the offense of "drag racing" is normally defined as "the operation of two or more vehicles from a point side by side at accelerating speed in competitive attempt to outdistance each other, or the operation of one or more vehicles over a common selected course, from the same point to the same point, for the purpose of comparing the relative speeds or power of acceleration of such vehicles or vehicles within a certain distance or time limit." See Uniform Vehicle Code 11-809(b).
